**Subject:** Determination that $12,074.50 was overpaid to Counter-Defendant Adrienne Rockenhaus, in
her capacity as SSA-appointed Representative Payee for Defendant Conrad A. Rockenhaus, during his
incarceration
This Exhibit is the written demand from the Social Security Administration determining that $12,074.50 in
Title II Disability Insurance benefits was overpaid to Counter-Defendant Adrienne Marjorie Rockenhaus as
SSA-appointed Representative Payee for Defendant Conrad Alan Rockenhaus while Defendant was
confined in a correctional institution for more than thirty days, and demanding refund of the overpaid sum.
The letter states in pertinent part that benefits could not be paid beginning October 2025 because Defendant
"is imprisoned for the conviction of a crime," and that Defendant "received $12,074.50 too much in benefits
because of his criminal conviction and confinement in a correctional institution for more than 30 days." The
letter further sets forth the rights of the addressee to request reconsideration or waiver of the overpayment
determination under SSA administrative process. Personally identifying information has been redacted from
this copy in accordance with this Court's prior orders on PII. The SSA notice tracking number (BNC#) is the
agency's internal mail-piece identifier and is not personally identifying information. This Exhibit is offered as
documentary support for the factual averments in Section III of the Affidavit. Monetary recovery of the
$12,074.50 SSDI overpayment is **not** sought in the contemporaneously filed Motion for Default Judgment
and is reserved for the proper forum (SSA's administrative process and any federal action that may follow),
as set forth in §VII.A of the Motion. The Exhibit informs the deemed-admitted record on breach of fiduciary
duty under 42 U.S.C. § 405(j), the discretionary considerations under Counterclaim Count B (accounting),
and the weighting and sanctions considerations under Counts G and H.
